Azerbaijan Republic legislation on subsoil and legal adjustment of subsoil use relations according to the terms of the Production Share Agreements: collisions and the causes of their occurrence

The article reviews existing Azerbaijan Republic legislation on subsoil as hierarchical structured under juridical power normative legal acts system. Gaps in legislation caused by the absence of some legal norms in it regulating public relations during geological exploration and production of several strategic types of minerals (oil, gas), signing contracts (agreements) to receive right on use of subsoil area for mineral production purposes and etc., are noted. The analysis of Azerbaijan legal acts concerning adoption, approval and granting permission for implementation of the Production Share Agreement is provided. Discrepancy among these acts and Azerbaijan Republic Constitution, legislation on subsoil, other adjacent normative legal acts resulted in collision. Reasons of collision and the procedure of their settlement are considered.
